Vorbehalt von Rechten – Training KI
Als Urheber und Vertreter der Verwertungsrechte erkenne ich das kreative Potential von maschinellem Lernen und künstliche Intelligenz (KI) an. Ich bestehe jedoch darauf, dass bei allen Anwendungen und Implementierungen von maschinellem Lernen und KI-Technologien die Rechte aller an der Erstellung, Vermarktung, Förderung und Verbreitung von unseren Fotografien oder anderen urheberrechtlich geschützten Inhalte Beteiligten voll und ganz gewahrt werden. Wer meine Fotografien, Texte, Kompositionen, Tonaufnahmen, Videos, Texte, Bilder, Grafiken, kreativen Werke, audiovisuelle Aufnahmen und sonstiges urheberrechtlich geschütztes geistiges Eigentum als Input für maschinelles Lernen oder KI-Anwendungen nutzen will, der muss von uns zuvor eine Lizenz erwerben.
Unter „Input“ verstehe ich insbesondere aber nicht abschließend, die Vervielfältigung, Verbreitung, öffentliche Aufführung, das Rippen, Scraping, Crawling, Clustering, Rotating, Cropping, Flipping, Scaling, Translating, Indexing, Catching, hinzufügen von Noise, Embedding, Mining, scanning, downloads oder die in Zukunft hierfür angewandten Techniken, die Aufnahme in oder die Erstellung einer Datenbank und jede sonstige Kürzung, Umgestaltung, Bearbeitung oder Veränderung unserer urheberechtlich geschützten Inhalte.
Soweit Artikel 4 der EU-Richtlinie 790/2019 oder ähnliche Gesetze in anderen Rechtsordnungen für urheberrechtlich geschützte Inhalte gelten, die mir gehören oder von mir kontrolliert werden, erklären und bekräftige ich, dass ich alle meine Rechte vorbehalten habe, weiterhin vorbehalten werde und keine Erlaubnis oder Lizenz für die oben genannten Verwendungszwecke erteilt bzw. vergeben habe. AFP-Photography/AndreasFrenkel-Piesch, as the creator, and representative of the exploitation rights, recognize the creative potential of machine learning and artificial intelligence (AI). However, I insist that all applications and implementations of machine learning and AI technologies fully respect the rights of all parties involved in the creation, marketing, promotion, and distribution of music or other copyrighted content.Anyone who wishes to use my photography/pictures, lyrics, compositions, sound recordings, videos, texts, images, graphics, creative works, audiovisual recordings, and other copyrighted intellectual property as input for machine learning or AI applications must first obtain a license from me.
By “input,” I mean, in particular but not exclusively, the reproduction, distribution, public performance, ripping, scraping, crawling, clustering, rotating, cropping, flipping, scaling, translating, indexing, catching, adding noise, embedding, mining, scanning, downloads or any techniques used for this purpose in the future, the inclusion in or creation of a database, and any other abridgement, alteration, adaptation, or modification of our copyrighted content.
To the extent that Article 4 of EU Directive 790/2019 or similar laws in other jurisdictions apply to copyrighted content owned or controlled by us, we declare and affirm that we have reserved all our rights, continue to reserve them, and have not granted or assigned any permission or license for the above-mentioned uses. We will take all necessary steps to prevent the unauthorized use of the works of AFP-Photography/AndreasFrenkel-Piesch, its author, or legal representatives.
